Only The Political Charlatans Protest Amid Rule Of Law, Nigeria Constitution And Electoral Act In A Democratic Settings

Referencing the Labour Party to the above caption, a lot has been said recently about the leadership tussle in the party,with Julius Abure at the loosing end.INEC follows strictly the Electoral Acts, a microcosm of the macrocosmic Nigeria Constitution.

Going back to the cradle, INEC was set up as a supreme, independent statutory body in Nigeria charged with the production of the statutory leaders that form the government at all levels in Nigeria in a national election.INEC,a law-abiding democratic umpire in Nigeria,stands existing on the balanced tripod of the rule of law, the nation’s constitution and the respective political parties’ constitutions. The INEC is not meant to answer to individuals’ selfish needs,but the dictates of the rule of law,as contained in the nation’s Electoral Acts.

INEC gives all political or public officers in Nigeria their statutory powers to operate,with its certificates of return after a freely and fairly conducted national election.The INEC can only take a sensitive order on matters of public importance from the Council of the State,the highest decision-making body in Nigeria.The Council of the States,headed by the sitting President of the Nigeria Federation and deputised by the Vice-President,does not report to the Presidency,but to Nigeria,to all citizens by upholding public interests above personal or selfish interests.

 

INEC is among the 14 Federal Statutory Bodies in Nigeria in line with the nation’s constitution. INEC’s functions are decided by the Council of the States, whom the prerogation for the appointment of its Chairman is vested on, as the same Supreme Council in Nigeria. The Council of the States comprises The President and the Vice-President, all the 36 States’ Governors and CBN Governor; the Attorney-general of the Federation and Minister of Justice, only serving Minister in the Council; the Senate President and the Speaker of the House of Representatives, all the former Chief Justices of the Supreme Court of Nigeria and current CJN, and all the former presidents of the Federation still living. The Council’s decision is for the overall best interest of the nation, particularly in upholding the sanctity of the rule of law and the nation’s constitution.

INEC works in line with the decisions of courts,the NECs of the respective registered political parties,and Council of the State,visibly represented by Attorney-general of the Federation,the heart of the Federal Government of Nigeria,as the Chief Law Officer of the Federation.

 

Those planning for unlawful protests in the INEC National Headquarters,Maitama Abuja, FCT on today,August 6,2025 under the banner of the Labour Party, should channel their requests and grievances, whether unholy or holy, to the LP NEC. They are going the wrong way if they insist on protesting,without following the due process of law. The NEC is the Supreme ruling organ of a political party,whose decisions bind legally on the party.

 

The LP NEC, having taken decision on Barr. Julius Abure whose tenure as the National Chairman of the party expired on June 8, 2023 and extended to June 8,2024 to pave way for the election year, 2023, relied upon the ruling of the Supreme Court of April 4,2025 and the prosecution order of the Attorney-general of the Federation to ratify Sens Nenadi Usman and Darlington Nwokocha as the Interim National Chairman and Secretary of the Labour Party.

The NEC,after its resolution of April 9,2025 at Transcorp Hilton,No 1 Aguiyi Ironsi Street, Maitama Abuja, FCT taken in my presence as a delegate, affirmed,through resolution,the Supreme Court Judgement of April 4,2025 that sacked Julius Abure as the National Chairman of the Labour Party and upheld the appeal made by Sen. Nenadi Usman-led NCC.

INEC only obeyed the law by complying with the Supreme Court Judgement of April 4,2025,the LP NEC Resolutions and the Prosecution Order of the Attorney-general of the Federation on the established cases of forgery,perjury and criminal conspiracy against Julius Abure.As the decision of the Labour Party NEC remains final,Julius Abure is no more the National Chairman of the Labour Party,and can only be addressed as the former National Chairman of the Labour Party.

By implications,all transactions on behalf of the LP by Julius Abure and co are illegal,null and void before the law and Constitution of the Federation.Those transactions may include candidates fielded by Julius Abure immediately after the Judgement of the Supreme Court of April 4,2023 that sacked him and all correspondences he made to the INEC from then. That means that INEC no longer recognised Barr. Julius Abure as the National Chairman of the Labour Party. Whatever Abure and co does under the banner of the Labour Party is illegal,null and void going forward.Whoever transacts LP’s business with Abure and co does so to his or her own peril.

 

In the eye of law, the LP NEC is headed and led by the party’s only Governor, His Excellency Dr. Alex Otti, CON, the Executive Governor of Abia State.INEC complies only with the decision of the LP NEC under Dr. Alex Otti. Only the candidates produced by the LP NEC backed by Dr. Alex Otti, under the NWC of the party headed by Sens Nenadi Usman and Darlington Nwokocha, National Chairman and Secretary of the Labour Party respectively can be uploaded by the INEC.

 

“Your protests to the INEC National Headquarters are baseless and illegal”, admonished the LP to Abure and co.INEC does not follow the will of man but the rule of law.Certainly, INEC will do the needful in its portal as it moves to invalidate Abure’s shenanigans in the LP since April 4,2025 he was sacked as the National Chairman of the Labour Party.INEC hereby validates the Sen. Nenadi Usman-led interim NWC of the Labour Party, pending the outcome of the party’s National Convention,2025.

All members of the Labour Party are urged to follow the rule of law and adhere strictly to the nation’s constitution and the party’s constitution as well.The INEC acts for the overall best interest of the nation as the only supreme statutory institution in Nigeria.The LP remains a united,one political party in the eye of the law,under the leadership of Sens Nenadi Usman and Darlington Nwokocha – led interim NWC of the party.
