Johannesburg High Court Blocks Pension Payout Amid Divorceย
The Johannesburg High Court has issued an interdict halting the Government Employees Pension Fund (GEPF) from paying out 50% of a dismissed man’s pension benefit, pending the outcome of an ongoing divorce case.
The couple, married in community of property, began divorce proceedings in November 2023. The wife, concerned her husband might cash in his pension after being dismissed from work, approached the court. She highlighted his failure to increase child maintenance for their three minor children, despite prior promises, and argued that the pension payout could deplete the joint estate before final settlement.

Although the husband previously assured that he would not access the pension, the court questioned his credibility โ especially as he had already backtracked on similar promises regarding child support.
In opposition, the husband claimed that freezing the pension was unnecessary and accused his wife of misusing the legal system. However, the court found no evidence of prejudice to him if half of the pension remained frozen and criticized his ability to fund legal opposition while neglecting financial responsibilities to his children.
Calling his actions โill-advised,โ the judge granted the order to freeze the pension and directed the GEPF not to proceed with any disbursement. The husband was also ordered to pay his wife’s legal costs.
